As far as IDM goes, with the nature of a lot of
artists wanting to share their work, I have yet to
read a convincing (actually ANY) statement by the RIAA
illustrating how they plan to differentiate willing /
unwilling sharing as well as the legitimacy of named
files. The IDM community ought to be very interested
in this.
If someone really does want to fight this all they
would have to do is set up a large network of fake top
10 files filled with noise (remember when Madonna did
that?), and get the word out to make it public
knowledge (try to get their identifications as close
to the original as possible). Get as many p2p nodes to
share the fake files as possible and this will create
a situation where having a person on a list as sharing
(c) material is meaningless as so many fakes are out
there. In fact, forces in the record labels put those
"trojan horses" out over the years - how could they
now punish someone for "keeping those trojan horses
shared to full others into downloading unauthorized
material in order to full people who want to steal
music - see RIAA, I'm on your side!" This would
create a climate where having a name assocoated with a
(c) file is legally meaningless (if it isn't already)
and thus these 10000 name lists would have no legal
validity.
As such for the RIAA to tighten screws they would have
to actually download material they suspect which would
create a logistic nightmare - and of course if just
one person was improperly accused anyone could
question the soundness of their accusations (ie class
action counter suit). The RIAA might be a large
interest group but I doubt it has enough resources to
be playing legal ping-pong with thousands of people,
especially if it isn't sure of its "list-of-names"
evidence.
