horseshit. napster is now banning people who share emusic files. this is how it works: if you are caught sharing emusic files, you will receive a warning window on napster. it will tell you that you must have your emusic files unshared within 24 hours or you will be banned from the service. what sucks is, i DID unshare my files within 24 hours of the time i received that message. and i still got banned. yay! oh well, guess i won't be buying anymore idm records cuz i have no way of hearing them before hand. btw, my emusic subscription has been cancelled. no crisis, but quite sucky, char _____________________________________________________________________________________ Get more from the Web. First off, EMusic sent out a letter to their subscribers a couple weeks ago giving their position on this and explaining what would happen. Even if this was not sent out, you are breaking the law. How can you get angry about the fact that you are no longer allowed to use a service for illegal means (violating copyright laws). Secondly, Napsters 'bad' is extremely easy to overcome. My assumption was that, since they were the only ones to distribute certain albums online, they could search by song name (title structure). I could be wrong, they did not specify. IMHO, it is a pretty neat service. There is a way to get yourself unbanned through the registry: http://david.weekly.org/code/napster-metallica.php3 You can also do a fresh install of windows to get rid of the registry entry. I don't think napster is banning IP's. If you have a non-static, dail-up IP it doesn't matter if they ban your IP because you get a new one everytime you log on. I believe there's a little tag within an mp3 saying whether or not it is 'copyrighted'. So perhaps there's some info embedded in the coding. I really don't know for sure though. If by chance all Napster is doing is reading the comment field, you could find a batch tag editor and remedy that pretty fast. Seems way too easy though, so I'm sure Napster is using a different method. Any ideas? I suppose if you're really set on sharing the files, you could convert to wave and back to mp3. No idea what effect this would have on quality, but I'd think that'd get rid of any embedded info. I'm sure we'll get some comments from those more versed in this than I. -Nathan

I'll try to clear a few things up. (Note - I'm not responsible for the concept or implementation of this policy, so please don't bombard me with flames. Here are some common misconceptions: 1) "EMusic is breaking into my computer! They're violating my privacy!" You've already violated your own privacy by allowing Napster to publish your songlist. The search program gets the same information off your computer as any other Napster user in the world. No more, no less. If you're concerned about the amount of information that's being published worldwide when you run Napster, talk to Napster. 2) "All you have to do to avoid getting caught is rename / remove ID3 tags from / re-encode your files." This won't work. The program uses an "audio signaturing" technology (developed by Relatable http://www.relatable.com ) to compare your files to the files in EMusic's catalog. The Relatable signature is based on the audio waveform (not the disk file) of the song in question, and allows fuzzy matching. Filename, ID3 tags or even which encoder or encode settings you used don't matter. 3) "I ripped those tracks from a CD I bought! They're not from EMusic at all!" EMusic doesn't care if you make MP3s from CDs, even if they're CDs by artists EMusic distributes. But when you start sharing them on Napster, you're distributing music for which EMusic has sole electronic distribution rights. EMusic has a responsibility to the artists and labels it represents to make a good faith effort to prevent unauthorized distribution of this music. Again, I am not responsible for these policies, so please don't scream at me. I am speaking as a private individual here, not as a representative of EMusic. i received this email from emusic. right after i read it, i went into the napster preferences and unshared my entire emusic folder. napster, being the unreliable program that it is, continued to share this folder after i had made the proper changes the the prefrences to unshare it. i noticed this a few days later when people were downloading files from my emusic directory. so i went back into the preferences and repeated the process. i checked again later and my emusic folder was still available. this went on and i finally gave up. about a week ago i received the warning window on napster. so i decided to try unsharing the folder again, even though each time i had done it in the past, it had failed. i tried unsharing each emusic subdirectory individually. this worked somewhat. but only some of the directories were successfully unshared each time i did this. they lessened and lessened, and finally my entire emusic folder was completely unavailable to any napster user. this final occurence took place just a few hours after i received the warning window. (btw, the warning window gives you 24 hours to comply before you are banned.) so why was i banned? because i complied with the warning? i'm pissed because i complied with the rules and i was still fucked. i tried doing all the unban debug and it worked, but apparently napster is not allowing any new users. not sure why, but when i tried to make a new user name, i got a window that said something like, "sorry, napster is not accepting new users as of now." funny, some big shit might be going down. anyone know? but no worries, i just used an older napster username that i thankfully remembered. and btw, i don't abuse napster like so many do. i use it as a means of previewing music (cuz i'm not satisfied with 15-second samples). and if i like a record or song, i'll buy it. if i don't, then i'll delete it. oh well. char _____________________________________________________________________________________ Get more from the Web. This is why you should use Hotline. It's thriving these days. Better than Napster and been around for longer. I had something similar happen a few months ago, and what I ended up having to do was create an entirely new folder and move the files into that so they wouldn't be shared. Personally I *like* buying blind most of the time. Of course, the longer you've been buying/browsing the genre, the greater the perpiscuity anyway. Also I tend to be of the opinion that the best stuff can't be assessed on initial listening (or sometimes several) anyways - especially of this ilk. Although music has several functions, that of 'paradigm stetching' is something which is more likely to take place with IDM than in some other categories - and that usually takes more than one spin around the block (for me anyway). jeff Rjyan Kidwell wrote:

I guess I often like buying blind too. But not always. I remember about a month ago I ordered a package of records, all of which spawned from hype on the list. I hadn't heard any of them, but decided to take a chance. I hated every last one of them. I think from that day on, I demanded to hear before I buy. The only label that I think does an exceptional job at letting possible customers hear the music before hand is Merck (www.m3rck.net). They give 45-60 sec. samples for each track on every release (even for some of the upcoming releases. Needless to say, I've bought almost every record from Merck, just cuz I've been provided with that option (and it's good stuff of course:). Other labels like Tigerbeat (not to dis) only give samples for a few tracks. For me anyways, that's not convincing enough. One thing I will give Tigerbeat tho, is that high quality mp3 samples are given rather than ra. And I appreciate that. So I guess Napster has somewhat spoiled me in that I can actually hear this music before I buy it, and that's not always been the case. The bad labels that depend on shear hype to sell a record are now being challenged to make good music. All the hype in the world isn't gonna get me to buy a record if I hear it first and it sucks. Like you were saying, this music can demand some extended attention to really be appreciated, and that's not possible with the resources that the labels make available :P
