[legally] selling music in a mixed format is just the same as selling it
unmixed, you should have permission from the rights holder of that music. A
lot of smaller labels turn a blind eye to mixes which are distributed in a
not for profit way to promote the people creating the mixes: the logic being
[I guess] that if you are distributing a their music as mixes to get DJ work
then you are going to end up Djing their records in a public space and
bringing them to a wider audience.
If you start selling the mix CD's you should really consider who put the
most work into it : you for doing the mix, or the included artists for
writing the music, getting a record deal, and whatever involvement they have
in the process. Is your mix a promotion for the artists included of
providing any help to them, or is it solely for your benefit? [IE do you
provide full release information for each track included].
Same old copyright argument that applies to mp3 distribution innit. There's
not a "right" answer to this, it's all about where your morals lie in the
rights of peoples work.
I'd consider that if you find it fair to profit from your effort put into
mixing other people's tracks then it is equally fair for the artists to
profit from producing those tracks, and you should not make the choice of
whether a particular artists track is used without their permission.
Of course if you aren't going to profit directly, or you see that you are
providing some form of service to the artists you might argue that you are
doing them a favour. I'm sure a lot of radio stations would be very very
happy if that was the situation, as they wouldn't have to pay to play the
music they do.
IMHO co-operation is better than self-gain, if you can help someone out and
they can help you and you can both profit then it's the best way forward.
The profit may be smaller overall for you in the short term, but in the long
term you'll find it easier. Why piss of a record label or artist that you
may have a chance to work with in the future?
