Hi!, recently some labels came in contact with me for my music. The problem is that all my tracks are heavily sample based (manipulated most of the times but basically sample based). I mean stabs, breaks, bass lines etc. So i;d like to know about the legal problems i may have if i release my music. I mean should i clear i.e a repitched horn stab or a rearranged drum break? From the snippets I listened to it looks like you are using the same jazz/break/stab samples everyone else is. No offence intended here at all btw, but sampled breaks from old funk records are being reused in about any genre that uses breaks I guess, so those can all be sued. Unless you are using some samples that can be easily recognised (James Brown grunts for instance) I think you're in the clear. As long as the original artist can't recognise his own stuff, you're safe. For the more recognisable breaks (Amen, Hot Pants, Funky Mule, ...) I'm not sure, but I never heard of any dnb producers getting sued for using those. I guess you can see those as public domain by now. I doubt Amon Tobin clears all his shit right? That would probably be a full time job on it's own. Good funky stuff you got there btw. i've always been VERY curious about this issue. it seems like to most producers this is the large elephant in the room that no one speaks of. my CD has been public for almost 1 year now and i haven't encountered any problems. of course, the more your music enters the public eye (ear), the more chance there is for being singled out for using uncleared samples. i basically had to set any paranoia aside and release what i wanted to release, samples and all. luckily, most of them are unrecognizable. n3wjack <n3wjack@n3wjack.net> wrote: 2008/1/4, ÉùÜííçò ×áôüëáò :

One that comes to mind is that dance record from some (I think a) Parisian producer with those Jane Fonda fitness samples in it. They never cleared those samples because they didn't expect the record to do much, but it caught on in a big way and after a while it was playing on MTv with some aerobics booby vid. Which is nice; By then Jane found out about it and decided she wanted a cut of the earnings, so they had to chip her in for that track.
