the fundimental problem is there is no minimum burden of proof that
must shown. ISPs are caught in the middle and often it is easier to
say goodbye to a customer than fight it (or more costly be held
partly responsible.)
we have been fighting laws like these for years, but ISPs have never
held the same sway as media companies (who also quickly moved in to
the data delivery business as well.)
