Classical chart-toppers THE PLANETS have been accused of ripping off the avant-garde, experimentalist JOHN CAGE because their new album contains a silent 60-second track. Cage, who died in 1992, famously composed the silence piece 4'33'' in his prime. Mike Batt, the man behind 'The Wombles' and Vanessa Mae who put the silent track on The Planets' album, has now received a letter from enraged representatives of Cage, The Guardian reports. Batt said: "I've received a letter on behalf of John Cage's music publishers. I was in hysterics when I read their letter. "As my mother said when I told her, 'Which part of the silence are they claiming you nicked?'. They say they are claiming copyright on a piece of mine called 'One Minute's Silence' on The Planets' album, which I credit Batt/Cage just for a laugh. well, if it's a rip off it's certainly not the first. John Lennon and Yoko Ono made a track called 'two minutes of silence'. soundgarden later made 'one minute of silence', which is a cover of Lennons minute (they didn't like Ono's minute). /adrian (cellular) http://cellmusic.cjb.net

great album, "void" itself is one of my favorites. and i would argue Cage is more this-listy than a lot of stuff i see posted here. anyway, more to the point, cf peters (Cage's publisher) is notorious for this. i performed in a run of Cage's "Theater Piece" being staged in the Theater Dept. at the U. of Maryland a few years back. of course i posted an announcement to the John Cage list to try and draw people to our show, and a few days later i get this very stern email from cf peters saying something to the effect of "how dare you stage a production of Cage's work, we expect full royalty payments, blah blah blah." of course, i didn't do any staging, i just performed in it and posted it to the list - and regardless, it was being staged by a university theater program that wasn't charging any admission at all. i got a couple more of those before i wrote back and went into a long tirade; if cf peters is approaching music and arts education by charging universities ROYALTIES for performing an important composer's work, then i don't expect i'll be purchasing any cf peters scores - or performing works - ever again and will recommend the school of music and dept. of theater do the same. needless to say, they didn't bother us anymore. m aka craque http://craque.net --------------------------------------------------------------------- To unsubscribe, e-mail: idm-unsubscribe@hyperreal.org For additional commands, e-mail: idm-help@hyperreal.org

I don't think Batt (the mediocre turd) would have been so amused if Cage has done a version of 'Wombling Free' without giving Batt a writing credit.
