Does this effect those who broadcast riaa artists only? I dj indie dnb/idm artists, and don't stream major label artists, but I'm wondering if even indie media providers get hit as well, it would be very cool to have a radio station of all indie idm list members. dj pie wrote:

my understanding is that this affects anyone who does not have a specific written agreement with the label or artist they're streaming. as i stated below, the riaa is empowered by this ruling to collect fees for ALL labels, not just riaa-member labels. this means that even if you play all indie music, unless you have a written agreement from the artists in question, you are liable for the fees. -rachel (aka dj pie) -- piesarenice.net

That's hot, so if you just download someone's mp3 from their website and don't have a written agreement with them, cause maybe they don't have a contact email or anything, then I could get sued into homelessness by the RIAA, that's wicked! The next step is to start executing indie producers/musicans who post their own original work on their homepages, make it so that its illeagal to posses music that's not released by an RIAA approved label! Why tis does kill indie radio is that if you did make something at all semi-popular, RIAA could use the court to shut you down just by pulling you into court through a lawsuit, then you have to prove to them that your radio station has signed agreements, and if you can't afford an attorney you just get forced to pull your site down until you can save up for one to get you through the legal system and get you agreements in front of a judge. They probably have to be signed on paper as well, so you have to start a new hobby as a manager of legal documents. dj pie wrote:

yep, as of midnight last night, somafm has pulled the plug. no more streams of kickass music with no commercials. i have made a conscious decision to avoid buying music from labels in the list of riaa members: http://www.riaa.com/About-Members-1.cfm i also intend to write to the riaa and tell them that. however, one thing to remember is that with this ruling, the riaa is empowered to collect fees not just for riaa member labels, but for ALL labels. i originally thought that i could continue my web radio show by by playing all non-riaa member labels, but that's not the case. i'd still be responsible for on the order of $8 per listener per day. -rachel piesarenice.net -- <marklar> I cried that I had no lever, until I met a man with no fulcrum. What would happen if everybody with a linux server and a streaming MP3 server set up their own station? Could they even afford to enforce this? This is ridiculous ...
