not really. the myspace terms of service changed after the acquisition to read: "By posting any Content to the public areas of the Website, you hereby grant to MySpace.com the non-exclusive, fully paid, worldwide license to use, publicly perform and display such Content on the Website. This license will terminate at the time you remove such Content from the Website." note the key phrases "non-exclusive" and the last sentence. all this seems to be is legalese for, "your music is providing content for our website but we don't owe you anything for it." just in case, say, a band with tens of thousands of hits started to think they should get a piece of the advertising dollars their page is generating for the site. here's the village voice article the quote was found in: http://www.villagevoice.com/screens/0533,webmccombs,66817,28.html

i don't see that it says that. the content is specifically performed and displayed on the website, where you put it in the first place. i suppose that means they could theoretically take a piece of your music and use it as a pop-up ad on the site for something else, but that seems far-fetched. at this point myspace is like ebay: there are other options, perhaps more indie and/or egalitarian, but it's the one *everyone * is on, and thus gives the best exposure.

No, they can't. Read it again:
quoted 5 lines "By posting any Content to the public areas of the Website, you> > "By posting any Content to the public areas of the Website, you > > hereby grant to MySpace.com the non-exclusive, fully paid, worldwide > > license to use, publicly perform and display such Content on the > > Website. This license will terminate at the time you remove such > > Content from the Website."
This is the important part: "...publicly perform and display such Content ON THE WEBSITE." In other words, by posting any content on MySpace.com, you are granting MySpace/Fox permission to "display" that content on MySpace.com. They do not have permission to use it anywhere else, and the permission you are granting is non-exclusive, meaning that you are able to post or use your content anywhere else. I'd lay odds that pretty much any commercial website on the Internet that allows people to post content of any sort will have a very similar clause in their user agreement. It's quite innocuous, really. Somehow, people jumped to the conclusion that Fox was going to start using music posted to MySpace as a free soundtrack to their TV shows or something. This legal statement doesn't allow for anything of the sort. Its a resource, and arguably a very good one for exposing yourself to a very large user base. If youre going to avoid any resource with a base root of corporate corruption, i sincerely hope you dont do most of your business on earth. Lumin Egress wrote:

it's entirely possible to exist on the internet without using any corporate music webhosting sites whatsoever. you are a fatalist and a defeatist for assuming there is no escaping the long reach of short-sighted. earth is the only known planet to have contracted the concept of business, so your last point is doubly redundant, even.
