The legal matter involving the Dick and Jane Records and Pearson Education (owners of the Dick and Jane books) has finally come to an end this weekend. The record label will be no more starting next month, but fortunately an agreement was reached that gave Dick and Jane Records some cash (nothing to brag about) to help out with starting the new record label, Optic Echo Records. This 3 month ordeal is finally over, which is quite the relief for the parties involved. Dick and Jane Records wants to thank everyone out there who supported us from the label's beginning to this unfortunate recent situation. Nothing but good news is expected for Optic Echo Records, so keep and eye out for 3 new albums expected out by next year, along with a free MP3 album to set things in motion. Hooray! Long live Optic Echo Records!!!!!! =) Those Pearson people are humourless fucks. I'd a parody 'Dick and Jane' t-shirt that I offered on ebay: "Evil is an Art Form": Dick has buried a cat up to the neck in the yard, and is advancing on the frightened pussy with a power lawn-mower, with a suitably evil grin on his pugnacious countenance. Ooooh-la-la. Well, anyway, ebay pulled the fucking auction: "INVALID". The dickheads at Pearson contacted ebay about my 0.99cent t-shirt, and ebay backed them!!!! WTF????? A parody: no copyright infringement evident. ebay cared not a whit: Pearson pay ebay a fee for the right to have ebay pull ~anything~ that Pearson deem violate their copyright. Over 0.99cents, I wasn't interested in fighting their lame-and-sorry ass. I gave the t-shirt to a friend. The low-down: ebay: **PLEASE READ THIS IMPORTANT EMAIL REGARDING YOUR LISTING(S)** We would like to let you know that we removed your listing: 2991907358 EVIL IS AN ART FORM T-Shirt Large SICK + JANE because the intellectual property rights owner notified us, under penalty of perjury, that your listing or the item itself infringes their copyright, trademark, or other rights. seek: "There was no copyright infringement involved. As you mention the alleged "property owner" notified you under penalty of perjury, please advise me of the copyright that they've claimed I've infringed. I have no need nor interest in contacting them at this time. thank you, suitably pissed" ebay: "As you know, eBay has not inspected the item you have listed. In addition, eBay is not an expert in the rights of any third parties. As a result, we are not in a position to make a judgment as to whether the listing is legal or authorized. When we receive a proper notice from a Verified Rights Owner or their agent stating that a listing is infringing, we are required by law to remove the listing. We removed your listing because we received such a notice from the rights owner. (Please refer to the email we sent when removing the item for the exact name of the rights owner that asked us to remove your listing)." seek: "hello - I have been informed by ebay that they've cancelled and ended my auction for a t-shirt as you've claimed my item violated your copyright. What copyright do you feel was violated, please?" Dickhead at Pearson: "The reason that your auction was ended because our client owns the rights to the DICK AND JANE characters and the other characters from the very popular reading books that featured not only Dick and Jane, but other characters as well including also their dog SPOT, their sister Sally, and their cat PUFF. Our clients rights include the copyrights to the images of the characters and the trademark rights in the names of the characters. The image on the t-shirt includes representations of our client's copyrighted characters and your accompanying ad reinforces this by using the names of the children, DICK and JANE, and their dog SPOT. There appears to be also a small child in the graphic whose image appears to be that of Dick and Jane's younger sister SALLY" Fuck Spot, fuck Sally, and fuck Pearson with Abner Louima's broom. seek --------------------------------------------------------------------- To unsubscribe, e-mail: idm-unsubscribe@hyperreal.org For additional commands, e-mail: idm-help@hyperreal.org
