Probably because the majority of major-label music is heard through radio,
which has a much worse quality compared to mp3. If they say "it's worse
than CD," the argument that "It's a lot better than radio" would also be valid.
It is now, of course, but it's not really part of the arguments being
used. Since radio play is essentially the same according to the record
execs, having even a "not exactly cd quality" mp3 copy is pretty much just
as bad.
