99.99% of the time, the artist knows exactly when and where their music is
used in television or film, though sometimes big bad labels or the music
supervisors for the media entity neglect to secure said artist's
permission. For instance, Huey Lewis was muy pissed when "Hip To Be
Square" showed up on the soundtrack for "American Psycho" and it had to be
withdrawn from record stores shortly thereafter because they lacked the
artist's approval. I guess Huey was worried that it was cutting into
potential CD sales on "Fore!"
I can't comment on Aphex situation, because I don't know anything about it
(haven't even seen the commercial). It's an older Aphex track, therefore
Sire most likely would have to have been approached if the commercial's
origin was North America.
And since because someone asked, "Double Figure" is out on the 28th/29th
of May depending on where you live on our big blue marble.
