posted for Joel & Ozzy please direct all responses to them at distro@safetyinnumbers.net ---------------------------------------------------------------- << Since early November last year AI has been owed for sales of Tim Koch's "Please Don't Tell Me That's Your Volvo" CD by SiN/SAFE. and that due to their tardiness in paying up (9 weeks!) the money for pressing up the new Sense EP is unavailable. This is despite explaining to them numerous times that the money is needed to release Sense's CD. AI is your typical small label with limited cash flow and the label needs the substantial sum that is owed to it by SiN/SAFE to pay for the manufacturing of Sense's Fourier Transformations EP.>> Short version: SAFE has kept open communication with John and AI about his CDs and has made payment for all sold copies. Unfortunately SAFE nor any other North American distributor will be distributing AI in the near future, as we are not the only distributors who have chosen to not distribute AI. Long version: SAFE not SiN has been distributing Tim Koch's "Please Don't Tell Me That's Your Volvo" CD since mid September. Terms were as following: Net 60 days (payment of sold units within 60 days of receiving goods) 100 CD's at $10.00 wholesale. As some of you may know this would mean a $17.99 - $19.99 retail price. A few days before the agreed net 60 was due John asked for us to relist the CD at $8.00 wholesale, ($14.99 - $15.99 retail) since less than 30 copies were sold in the US, even though that is what he should have done in the first place, instead of trying to make the extra 2 bucks. We expressed our concerns with this, as any customer who spent $17.99 - $19.99 to support Tim and AI would be quite upset to see it relisted a few weeks later at $14.99 - $15.99. John even went as far as to contact our shops directly. Obviously they expressed the same concerns. We agreed to help out John (which no one else seems to want to do) and relist the CD a few weeks later at the lower price. Few weeks later SAFE relisted the CD at the new lower price. At this price we are also able to offer the item to other distributors so we were about to sell out of the CD. Before we could communicate to John to give us some extra time so we could sell out and make full payment he sent us an extremely foul e-mail stating that he needed his money right away for the upcoming release, almost as if we had never spoken about relisting the CD. We decided to place John a call as we wanted all matters to be cleared. He seemed very apologetic of his e-mail and agreed to touch base in a week or so. Unfortunately we were unable to sell the last 12 or so copies. We decided to make payment for the sold copies, gave some estimates, and exchanged information. Insufficient info (bank name, bank address, etc.) was given to SAFE by John for bank transfer. SAFE contacted John with the problem and stated that bank transfer can only be made on Fridays since the bank is in the city and must be done in person. SAFE also e-mailed John with new figures which did not seem to match (by a few copies) our previous e-mail or John's head count of our shops orders. Again John decided to e-mail us accusing us of trying to swindle him out of $10.00. These on-going problems and accusations have caused us to not want to support nor corporate with John. As for John's payment, it was made on 01/12/01 and all unsold copies will be sent back. It is unfortunate that Tim's music has to be represented by such a difficult label that will soon burn all their bridges. As for Sense's he e-mailed us about a week ago: Subject WTF! He wanted to know why we were taking pre-orders of the AI CD when he still had it on his HD. Through a few exchange of e-mails we discovered that John had been making the postings to several lists without Sense's nor SAFE's consent. Seems like everyone we have spoken to says the same "I should have guessed this was JOHN's doing". John if you are out there we'd appreciate if you answered your phone. Apologies to the list for all this nonsense but unfortunately John seems to think it's OK to post your business matters in this public form. Long version: SAFE not SiN has been distributing Tim Koch's "Please Don't Tell Me That's Your Volvo" CD since mid September. Aouch how come I have to mail my CDs to you from France and manage to sell them for $7 only, whereas a US label would sell them to you for 10 ?! Thanks joel and ozzy it is good to have two versions of a story... Not that we wanna debate over it, just good to know.
