B: the shop that's having the going out of business sale is really lame C: I bet you eat monkeys and you smell Wouldn't it work just to say "Etoys is just an evil as the Amazon.com/Toy's R Us alliance, or many other retailers"? I just said in my email that I need a post code of the delayed parcel to start tracking and they immediately sent out the same order to me by DHL! I really appreciated it... 8) Alien np. to further qualify: [from http://www.toywar.com] THE TOYWAR-STORY: the TOYWAR.com resistance game was launched to protect etoy from aggressive take-over attempts and to win the historic domain name battle between the etoy.CORPORATION (legendary internet art giant, incorporated 1994) and eToys Inc. (one of the biggest e-commerce companies, incorporated 1996). after the etoy.SHAREHOLDERS (art collectors and fans) rejected a ridiculous offer of $516,000 for the eBRAND etoy.com (registered for experimental entertainment and cultural business operations), eToys Inc. filed a naive lawsuit against etoy. the toy retailer accused etoy of unfair competition, trademark delusion, security fraud, illegal stock market operation, pornographic content, offensive behaviour and terrorist activity. this strategy failed terribly: etoy, specializing in and awarded for surreal incubations, cultural viruses and impact management decided to strike back and turned the case into a toy harbor of e-commerce: 1798 activists, artists, lawyers, celebrities and journalists were selected and recruited between november 1999 and february 2000 to establish a playful toy army. TOYWAR worked like a swarm of bees. hundreds of well-informed people and media experts contested the aggressor on every level (filing counter court cases, infiltrating customer service, pr departments, the press, investor news groups and also on the level of federal trade commission etc.). more than 300 articles (New York Times, Wall Street Journal, Le Monde, CNN) reported the story and 250 resistance sites and net-shelters were established. result: within 2 months the eToys Inc. stock (NASDAQ: ETYS) dropped from $67 (the day the battle started) to $15 (the day eToys Inc. finally dropped the case). TOYWAR was the most expensive performance in art history: $4.5 billion in damage! a glorious victory for the etoy.CORPORATION which compensated activists with etoy.SHARES: in march 2000 hundreds of brave TOY.soldiers transformed into etoy.CO-OWNERS with voting rights. karma's a bitch...

If you really buy any of that shit, you're truly deluded. eToys stock dropped because it was ridiculously overpriced, at around the same time most other bloated tech stocks started dropping. Toywar/rtMark utilized this coincidence to make themselves look good, which in my eyes is just as bad as what eToys - actually, no, not eToys - one misguided dickhead at eToys - did. I used to work there, and the majority of people I interacted with, including most of upper management, were highly pissed off about the whole affair, but only got wind of it once it had already escalated to an uncontrollable point. Ehh, fuck it, this is a pointless conversation. Suppose you had the domain www.davidgee.com reserved, and some big corp under the name Irving David/Merv Gee Inc. decided to threaten you with a lawsuit saying that www.davidgee.com was infringing on their trademark, etc. Ignoring the hindsight you now have, I doubt the first thought you would have would be "Garsh. I think this is just the work of some renegade dolt at David/Gee Inc. that's misguided. I think I'll just ride this out until the upper management discovers what's going on eons later -- possibly well after the fallout of the lawsuit -- and out the weasel." With all due respect to the others at eToys, Inc. -- they're still responsible for the fallout of the dolt. When an employee is given power enough to perform actions on behalf of the company, that company has officially "spoken" if that employee "speaks". TOYWAR/rtmark had every right to feel threatened. If they had only known you personally, then maybe none of this would have happened. But people generally don't give huge legal hammers from the sky the benefit of the doubt as a first instinct. There's something called "fight or flight". While I don't defend every grass roots media blitz as earnest, I think accusing TOYWAR of cheap publicity, in this case, isn't entirely fair. ======================================================================= Brian MacDonald <brianm@kuci.org> ======================================================================= --------------------------------------------------------------------- To unsubscribe, e-mail: idm-unsubscribe@hyperreal.org For additional commands, e-mail: idm-help@hyperreal.org

So.... you're saying that eToys *didn't* actually sue etoy.com to try to stop them from using their own domain name, even though etoy.com predated eToys by TWO YEARS? Are you saying that eToys *didn't* use totally fraudulent courtroom tactics to try to shut down a legitimate and independent group that had nothing, whatsoever, to do with eToys? I agree with you that the etoy.com resistance probably didn't have any impact on eToys stock price, or at least not the impact claimed in the earlier statement (though I do think that there's a semi-parodic air of "revolutionary communication" that probably explains the exaggerations), but beyond that, your assertions just don't square with *everything* else I've read on the matter. At least you don't sound too defensive about it. Let me guess, they laid you off, and you're *still* toeing the corporate line? If you really buy any of that shit, you're truly deluded. eToys stock dropped because it was ridiculously overpriced, at around the same time most other bloated tech stocks started dropping. Toywar/rtMark utilized this coincidence to make themselves look good, which in my eyes is just as bad as what eToys - actually, no, not eToys - one misguided dickhead at eToys - did. I used to work there, and the majority of people I interacted with, including most of upper management, were highly pissed off about the whole affair, but only got wind of it once it had already escalated to an uncontrollable point. Ehh, fuck it, this is a pointless conversation. no, I'm saying that the lawsuit was the end result of a lot of wrangling and pigheadedness on both parts. etoy.com is as stupid as etoys.com. Revolutionary, my ass. They're a bunch of dipshits, and the most revolutionary thing they've done is provided a neat trick for porn spammers. I'm not defending eToys, I'm saying making a blanket statement like "ETOYS IS EVIL" because of some past event that was ultimately resolved, and which you know very little about, is pretty stupid.

Actually, I left long before the layoffs. I'm not psychic, but it wasn't exactly difficult to see what was ahead. I'm not toeing the corporate line, either, when this topic was actually SOMEWHAT RELEVANT, I made my fair share of stink about it at work. However, when I saw my name up on RTMark as being one of the people who "quit" because of the whole deal, it became apparent that they were as full of shit as eToys was, and I lost interest in the matter. I was more pissed off about the fact that eToys was making it's web people work in customer service and the warehouses to meet holiday demand, anyway. Now THAT was evil. My point is, I guess, that the whole thing was more involved than pointed out on /. and rtMark at the time, and the lawsuit wasn't the initial reaction, it was a stupid recourse taken when everything else had failed. I'm pissed that eToys failed because it's a sign that internet e-Commerce is merely going consolidate the power of corporate giants like WalMart, instead of providing entirely new channels. eToys was a step in the right direction - overall, the corporate culture was relaxed, I could do what the fuck I wanted most of the time - as big as it was, there was a 'startup' atmosphere, and most of the people I worked with were cool, liberal and open-minded. I don't think there are going to be too many places like that around in 2 or 3 years. I'm not toeing the corporate line anymore than I'm willing to toe the rtMark line. I prefer to think for myself and make my own judgements, thanks. david

Here is what I know: a very large business with lots of money tried to take something that was not their property by any definition. They used their money to strongarm it away in order to increase their profits, like a bully taking lunch money. At this point, etoy.com had every right to make any sort of ridiculous move they needed to in order to fight the bully away. It's sad, yes, that they had to go to such outlandish steps, but it's what they needed to do in order to get the attention of the teachers and the principal so this bully would go away. Any other case like this, where big companies bully their way in to something that is not theirs, usually ends in the little guy getting picked on, face bloody, in the dirt with no one the wiser and the bully a little bit richer. I'm just glad the bully did not win this time.

Silver Jam-It Digitial Sound Mixer by KB Gear Interactive Customer Comments and Ratings Sarah, mother of 2, a grown-up from Grand Rapids, MI Really cool and fun! My son got this for his birthday and absolutely loves it. He (11) and his 7 year old sister spend hours playing with Jam-It on the computer. Their favorite thing to do is to record their voices and then make them sound really funny, like a martian or with an echo, and then add the sound to digital pictures of themselves to make digital pictures that talk with moving lips. It's really fun & there are a ton of options. I'd definitely recommend this product! Billy, hormonally imbalanced 4-year-old, from The 5th Moon of the planet Molexica, apartment # 222 I think I saw something like this in the SCREAM movie trilogy. I wanted to make sure it was, so I purchased one. I used it in combination with a cellular telephone to gain access to a woman's home, then raped and killed her. Thanks Jam-It! Oh yea, to the woman who posted the message above mine....how the hell do YOU know what a "Martian" sounds like? They probably don't exist, and even if they do, I doubt they would be a lifeform complex enough to emit any sound at all, let alone speech. You suck. One more thing, the batteries wear out too fast, and I wish it came in other colors. --------------------------------------------------------------------- To unsubscribe, e-mail: idm-unsubscribe@hyperreal.org For additional commands, e-mail: idm-help@hyperreal.org
