I was just listening to Jega's Spectrum and was wondering if Jega would have to give credit to Dave Brubeck for the obvious "Take Five" sample played throughout track 4 ("Red Mullet"). I just figured Matador might run into legal trouble considering they're a bigger label than Planet u, and it may get noticed. -Steve np: electric sheep - locust lunch 12" [it didn't strike me at first, but i really dig this record. Which is the obvious Take 5 sample? The drumming? I grew up listening to the Dave Brubeck record (my mom's copy of 'Take 5' is powdery grey on that track). I guess I can hear that the drums themselves sound like the drum solo from take five, but a) the piece is in 4 and b) the drumming is totally rearranged and reprogrammed. The history of sample piracy suggests that people are not very likely to pursue people who lift small parts of drum loops or break. Otherwise about a thousand people would have been sued by James Brown and Clyde Stubblefield for "funky drummer", or by whatever remains of the Winstons over the "amen brother" break, or Incredible Bongo Band over "apache."

Its quite possible that permission was granted and there may be no legal problems. Here are a few of things I have noticed that would most certainly go against the grain: The Funkenstort 12" by Funkstorung: On the backside, it clearly shows the Apple logo which is a registered trademark by Apple. A track from the Spacepimp 12" on Clear has a sample of the "Axl Foley Theme" from "Beverly Hills Cop" which was wriiten by Jan Hammer. The "Type Zero" 12" on Planet µ: Anime / Robotech / Gundam figure on the cover. perhaps thats why it was limited to 750 copies of the fear that it might make its way to Japan. On Endlessnessism: The track remixed by Funki Porcini... contains that Apple / Macintosh start-up tone. Wagon Christ - Tally Ho! The first track contains piano samples from United Airlines. Some of the above maybe border line. Who really knows??? I can understand, give credit where credit is due... but if you can get away with it. Fine by me. cf "Reboot" by 1.8.7 on _Quality Rolls_ Then again, there's "Fuck You Today", featuring the Windows startup tone (thanks, Brian Eno!) on Fluoroscopic Kid's new release. He works in technical support. He hates that sound. He's entitled. :)

There's another big big big sample on _Honkeytronica_ that gets played with and twisted (in a fun way, too). I'm not all that worried since an ultra-limited tape release doesn't seem like a money maker for the lawsuit hungry, you know?
