I'm not too sure about that. Why do speakers typically have
ranges that peak out at 20KHz then? Even as infants with undamaged
hearing I'd be suprised if we could hear anything past that.

Even if you sampled the 5KHz sine wave at 10KHz you still wouldn't
be able to reconstruct the sine wave, since each sample would still be
exactly equal to all the others. Really, the sampling frequency needs to
be *strictly greater than* twice the highest frequency component in the
signal, not greater than or equal to.
